Terms of Service

1. Acceptance of Terms

By creating an account or using ShipSite ("the Service"), operated by MPH GL GmbH, Dammstrasse 19, 6300 Zug, Switzerland, you agree to these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

ShipSite provides an open-source framework for building marketing sites and a managed cloud platform for editing, building, and deploying those sites. The cloud platform includes a web-based content editor, automatic deployments via GitHub, SEO validation, and custom domain management.

3. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@shipsite.dev if you suspect unauthorized access.

4. Your Content

You retain all rights to the content you create and deploy through ShipSite. We do not claim ownership of your source code, content, or deployed sites. You grant us a limited license to access, build, and deploy your content as necessary to provide the Service.

5. Fair Use

All plans are subject to fair use limits. The deploy and build limits for each plan are outlined on our pricing page. We reserve the right to throttle or suspend accounts that consistently exceed their plan limits or that use the platform in ways that degrade service for others. We will notify you before taking any action and give you the opportunity to upgrade or reduce usage.

6. Prohibited Uses

You may not use ShipSite to: host content that is illegal, harmful, or infringes on the rights of others; distribute malware or engage in phishing; perform cryptocurrency mining or other resource-intensive operations unrelated to site hosting; resell the Service without authorization; or attempt to circumvent platform security or access controls.

7. Payment and Billing

Paid plans are billed monthly or annually through Paddle, our merchant of record. Paddle handles all payment processing, tax calculation, and compliance. Prices are listed in USD and may be subject to local taxes. You can cancel your subscription at any time, and the cancellation takes effect at the end of the current billing period.

8. Uptime and Availability

We aim to maintain 99.9% uptime for deployed sites and the platform dashboard. Scheduled maintenance windows are announced at least 24 hours in advance. We are not liable for downtime caused by third-party services, force majeure events, or factors outside our reasonable control.

9. Termination

You may close your account at any time from your account settings. We may suspend or terminate accounts that violate these terms. Upon termination, your deployed sites will be taken offline, but your source code remains in your GitHub repository.

10. Limitation of Liability

ShipSite is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the twelve months preceding the claim.

11. Applicable Law and Jurisdiction

These terms are governed by Swiss law. The exclusive place of jurisdiction for all disputes arising from or relating to these terms is the registered office of MPH GL GmbH in Zug, Switzerland.

12. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes by email or through the platform dashboard at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
